Tamil Nadu Shops and Establishment Act,1947 Exemption to all Liquefied Petroleum Gas Cylinder distributing agencies in Tamil Nadu from section 11(1) of the said Act- Orders – Issued.

ORDER:

In the G.O. read above the Government have exempted the Liquefied Petroleum Gas Cylinder Distributing Centres of Bharat Petroleum Corporation Limited from the provisions of section 11(1) of the Tamil Nadu Shops and Establishment Act,1947(Tamil Nadu Act XXXVI of 1947).

2.The Commissioner of Labour has stated that since similar request emanated from Hindustan Petroleum Corporation also, all the Liquefied Petroleum Gas Distribution Centres in sub-section(1) of section 11 of the said Act. Instead of sending separate proposal for granting permanent exemption to each and every Liquefied Petroleum Gas distributors in Tamil Nadu, the Commissioner of Labour has recommended to supercede the previous Notification in which Liquefied Petroleum Gas Distributors of Bharat Petroleum Corporation were granted exemption from the Tamil Nadu Shops and Establishment Act, 1947 for three years.

3. The Government accept the proposal of the Commissioner of Labour and accord permanent exemption to all the Liquefied Petroleum Gas Distributing Agencies from the provisions of sub-sections(1) of section 11 of the Act considering the immense benefit to the public.

4. Accordingly, the following Notification will be published in the Tamil Nadu Government Gazette:-

NOTIFICATION

In exercise of the powers conferred by section 6 of the Tamil Nadu Shops and Establishments Act, 1947 (Tamil Nadu Act XXXVI of 1947) and in supersession of the Labour and Employment Department Notification No.II(2) LE/969/2002, dated the 23 rd October 2002, published at pages 582 to 585 of Part II-Section 2 of the Tamil Nadu Government Gazette, dated the 20 th November 2002, the Governor of Tamil Nadu hereby exempts permanently all the Packed Liquefied Petroleum Gas Cylinder Distributing Agencies in the State of Tamil Nadu from the provisions of sub-section (1) of section 11 of the said Act, subject to the following conditions, namely:-

(1) The employees should be granted weekly holiday.

(2) All the registers prescribed under the Tamil Nadu Shops and Establishments Act,1947(Tamil Nadu Act XXXVI of 1947 and the Tamil Nadu Shops and Establishments Rules 1948 should be maintained.

(3) The said exemption will be cancelled if any genuine complaints are received from the employees.
