ORDER:

The Commissioner of Labour has stated that according to Rule 11 of the Tamil Nadu Plantations Labour Rules 1955, a report from the Health Officer or by a Certifying Surgeon, if the former is not available, as to the fitness for human consumption of the water supplied to workers has to be obtained in respect of every plantation. In the 47 th Plantation Labour Advisory Committee meeting held on 9.7.03 at Chennai, the issue regarding amendment to Rule 11 of the Tamilnadu Plantations Labour Rules 1955 was discussed. The representatives of the Management expressed their difficulties in obtaining the potability certificate and it was represented both by the management representatives as well as union representatives that the existing Rule is out-dated and it may be amended suitably. It was also suggested that since the Water Supply and Drainage Board has installed testing laboratories in each district with sufficient number of equipments and staff in the Laboratories to test the water samples, the existing Rule may be amended suitably to the effect that the Potability Certificate may also be obtained from the Tamil Nadu Water Supply and Drainage Board Testing Laboratories.

2. The Director of Public Health and Preventive Medicine has also agreed to the above suggestion. The Commissioner of Labour, has, therefore, proposed that Rule 11 of the Tamil Nadu Plantation Labour Rules, 1955 may be amended suitably to the effect that potability certificate may also be obtained from the Tamil Nadu Water Supply and Drainage Board Testing Laboratories also

3. The Government, accordingly, direct that the appended Notification shall be published in the Tamil Nadu Government Gazette. The Works Manager Government Central Press, Chennai-79, is requested to send copies of the Tamil Nadu Government Gazette, in which the Notification is published to the Government and the Commissioner of Labour, Chennai-6 (each 10 copies) for the purpose of record.

APPENDIX.

NOTIFICATION.

The following draft of an amendment to the Tamil Nadu Plantations Labur Rules, 1955, which it is proposed to make in exercise of the powers conferred by sub-section (1) of section 43 of the Plantations Labour Act, 1951 (Central Act LXIX of 1951), is hereby published as required by the said sub-section (1) of section 43 of the said Act. 

2. Notice is hereby given that the draft amendment will be taken into consideration on or after the expiry of six weeks from the date of publication of this Notification in the Tamil Nadu Government Gazette and that any objection or suggestion, which may be received from any person with respect thereto before the expiry of the aforesaid period, will be considered by the Government of Tamil Nadu. Objection and suggestion, if any, should be addressed to the Principal Secretary to Government of Tamil Nadu, Labour and Employment Department, Fort St.George, Chennai-600 009, through the Commissioner of Laour, Teynampet, Chennai-600 006.

In the said Rules, for rule 11, the following rule shall be substituted, namely:-

“11. Report from the Health Officer.-

The Inspector may, by an order, in writing, direct the employer to obtain at such time or at such intervals, as he may direct, a report either from the Health Officer or the Certifying Surgeon or from the Tamil Nadu Water Supply and Drainage Board Testing Laboratories as to the fitness for human consumption of the water supplied to workers, and in every case to submit to the Inspector a copy of such report as soon as it is received”.
